BP Plc formally filed a petition on August 1 with the United States Supreme Court, alleging that the U.S. Fifth Circuit Court of Appeals made a mistake in approving a multi-billion dollar settlement that is being used to pay off claimants that were not directly affected by the 2010 Gulf of Mexico oil spill, USA Today reported on August 2.
The formal complaint has been brewing since May, when the New Orleans court decided to uphold the 2012 settlement agreement crafted by claims administrator Patrick Juneau. A similar complaint filed by BP earlier had already been rejected by the Supreme Court in June. This new complaint will likely be tackled by the Supreme Court in October.
BP established the Deepwater Horizon Claims Center to give service to Gulf of Mexico oil spill claimants, but the process of filing a claim with this agency proved to be tedious and time-consuming, and many do not qualify.
